1. Agreement to Terms

By accessing or using FastPay, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Eligibility

You must be at least 18 years of age to use FastPay. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using FastPay on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Service Description

FastPay is a payment management platform that facilitates auto financing between dealers and customers. We provide tools to:

• View payment schedules and balances
• Process online payments
• Track payment history
• Receive payment notifications

4. User Accounts

Account Creation

• Accounts are created by authorized auto dealers
• You must provide accurate and complete information
• You are responsible for maintaining account security
• Notify us immediately of unauthorized access

Account Access

• One account per financing agreement
• Non-transferable access credentials
• Automatic timeout for security
• Phone verification required for SMS notifications

5. Payment Processing

Payment Methods

• Credit and debit cards accepted
• Payments processed through Stripe
• Processing fees may apply
• Saved payment methods encrypted securely

Payment Terms

• Payments due according to your financing agreement
• Late payments may incur fees per dealer terms
• Failed payments will trigger notifications
• Extra payments reduce principal balance

Cash Advance Notice

Credit card payments may be treated as cash advances by your card issuer, which may result in higher interest rates and additional fees. Please check with your card issuer for details.

Refund Policy

All payments made through FastPay are final and non-refundable. Once a payment is processed, it cannot be reversed except in cases of documented error or fraud. Any disputes regarding payments should be directed to your dealer.

6. User Responsibilities

You agree to:

• Make payments according to your schedule
• Keep contact information current
• Use the service lawfully
• Not attempt unauthorized access
• Report issues promptly

7. Privacy and Data

• Your information is protected per our Privacy Policy
• We do not sell personal information
• Data shared only as necessary for service operation
• You may update information through your account

8. Communications

Notifications

• Payment reminders sent 3 days before due date
• Confirmation messages for all transactions
• Critical alerts always sent regardless of preferences
• Standard messaging rates may apply for SMS

Language

• Service available in English and Spanish
• Legal documents provided in English

9. Intellectual Property

All FastPay content, features, and functionality are owned by FastPay and protected by copyright, trademark, and other laws.

10. Prohibited Uses

You may not:

• Use the service for illegal purposes or to facilitate unlawful activities
• Attempt to breach, probe, or test security measures or authentication systems
• Interfere with, disrupt, or create undue burden on service operation or infrastructure
• Impersonate others, provide false information, or create accounts under false pretenses
• Use automated systems, bots, scrapers, or similar tools without explicit permission
• Transmit viruses, malware, or any code of a destructive nature
• Harass, abuse, or harm other users or FastPay personnel
• Reverse engineer, decompile, or disassemble any part of the service
• Remove, obscure, or alter any legal notices displayed in or along with the service
• Use the service to send spam or unsolicited communications
• Violate any applicable local, state, national, or international law

11. Service Availability

• Service provided "as is" and "as available"
• We strive for 24/7 availability
• Scheduled maintenance with advance notice
• No guarantee of uninterrupted service

12. Limitation of Liability

FastPay is not liable for:

• Indirect or consequential damages
• Lost profits or data
• Service interruptions
• Third-party actions
• Damages exceeding fees paid

13. Indemnification

You agree to indemnify, defend, and hold harmless FastPay, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use or misuse of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or share through the service
• Your violation of any applicable laws or regulations

14. Dispute Resolution

Initial Resolution

• Contact your dealer for account issues
• Most issues resolved within 24 hours
• Escalation process available

Governing Law and Jurisdiction

These terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to or use of the service shall be instituted exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of such courts.

Statute of Limitations

You agree that any claim or cause of action arising out of or related to these Terms or the service must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

15. Changes to Terms

We may modify these terms with notice via:

• Continued use constitutes acceptance

16. Termination

• Request through your dealer

• Compliance with applicable financing laws
• Interest calculated per agreement terms

18. Third-Party Services

FastPay uses third-party services including payment processors and other service providers. We are not responsible for the actions, content, accuracy, or reliability of third-party services. Your use of third-party services is governed by their respective terms and conditions.

19. DMCA and Copyright Policy

If you believe that content on FastPay infringes your copyright, please contact us at your dealer with:

• Description of the copyrighted work
• Location of the infringing material
• Your contact information
• Statement of good faith belief
• Statement of accuracy under penalty of perjury

20. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
